P&D Process Guidelines

The Protest and Disciplinary Committee (P&D Committee) only meets if there are issues involving players, coaches, managers, parents or spectators either on or off the field.

All persons listed above or any person associated with NWSWF Association can be requested to appear at a P&D hearing. If an incident report is received by the P&D Co-ordinator, an inquiry will commence and if a determination is made to conduct a P&D hearing, all persons will be notified via the Club Delegate. 

Automatic penalties apply to a first offence in each category and repeat offenders may be cited to appear before the P&D Committee. The player's previous disciplinary record is considered by the P&D Committee when making decisions. Players that are sent off the field may be requested to attend a P&D hearing even if it is a first offence. Offences of a serious nature and those not covered in the Table of Offences may require attendance at a P&D hearing. Refer By-Law 21.3 re Player cautioned whilst serving a suspended sentence.

An incident report may be submitted by referees, officials and any person associated with NWSWF. An incident report must be submitted to the NWSWF Secretary by the Club Delegate only. Reports from individuals will not be accepted. The P&D Committee reserves the right to increase penalties on the receipt of a referee's report and/or an incident report.

FLOW CHART: Automatic Penalty

Step 1             A player has received a red card.

Step 2             Table of Offences automatic penalty.

Step 3             The Protests and Disciplinary (P&D) Co-ordinator will be notified by Gladesville Hornsby Referee Association on or before Tuesday 7pm following the incident.

Step 4             The P&D Co-ordinator will notify the Club Delegate of the Automatic Penalty as outlined in the Table of Offences. Automatic penalties apply to a first offence in each category and repeat offenders may be cited to appear before the P&D Committee. The player's previous disciplinary record is considered by the P&D committee when making decisions.

                        The Automatic Penalties are guidelines only and the P&D Committee reserves the right to vary penalties as appropriate.

Step 5             The Club Delegate will notify their player of the automatic penalty. The suspension commences as outlined in the Red Card Notification emailed to the delegate. The player serves the suspension.

Step 6             All penalties must be served immediately following the offence(s). Games are scheduled games for the competition the player is registered and forfeits by the opposition in that competition only. Byes do not count as games and the player can not play in another competition until the penalty is served. NWSWF By-Law 21.1.9.

Step 7             The player's details and suspension weeks will be posted on the NWSWF Website. All details remain on the NWSWF database.

FLOW CHART: Red Card P&D Judiciary Hearing

Step 1             A player has received a red card.

Step 2             The Protests and Disciplinary (P&D) Co-ordinator will be notified by Gladesville Hornsby Referee Association on or before Tuesday 7pm following the incident.

Step 3             The P&D Co-ordinator will notify the club delegate of the Automatic Penalty as outlined in the Table of Offences. Automatic penalties apply to a first offence in each category and repeat offenders may be cited to appear before the P&D Committee. The player's previous disciplinary record is considered by the P&D Committee when making decisions. The Automatic Penalties are guidelines only and the P&D Committee reserves the right to vary penalties as appropriate.

Step 4             The Club Delegate will notify their player of the automatic penalty. The suspension commences as outlined in the Red Card Notification emailed to the delegate.

Step 5             If the player requests to appear before the P&D Committee or where a player has been requested to appear at a hearing, she shall not be eligible to play until her case has been heard.

Step 6             The Club Delegate will notify the P&D Co-ordinator by the specified time that the player requests a hearing OR if the player is cited to appear at a hearing the P&D Co-ordinator will notify the delegate of the hearing date/time. A Notice to Attend P&D Hearing will be emailed to the club delegate outlining the offence as per the referee or incident report.

Step 7             The player must provide the P&D Committee with all witness statements and a short summary of why the player is not guilty of the offence by 7pm two days before the P&D hearing.

Step 8             All witnesses must be available to attend the P&D hearing.

Step 9             P&D hearing is conducted and a Notice of Determination is forwarded to the club delegate as soon as the notice is completed.

Step 10           Determination is accepted by the player OR Appeals process commences as be Appeals Flow Chart outlined on page 5.

Note:                      The P&D Committee is at liberty to dismiss the application for a hearing following review of the paperwork should the paperwork be considered to be frivolous or vexatious.

FLOW CHART: Notice to attend a P&D Disciplinary Hearing

Step 1             A Notice of Complaint and Notice to Attend a P&D hearing will be forwarded to the Club Delegate if a player, coach, manager, parent, spectator or any other person associated with NWSWF Association is cited to appear at a P&D hearing.

Step 2             If a player has been cited to appear at a hearing, she shall not be eligible to play until her case has been heard. If a coach, manager, parent, spectator or any persons associated with NWSWF Association is cited to appear at a hearing, the club delegate will be advised by the P&D Co-ordinator of any restrictions that are placed upon these persons prior to the hearing.

Step 3             The Notice of Complaint will outline the reasons for the person being cited to appear and any relevant paperwork will be forwarded prior to the hearing. The P&D Committee may request information regarding the complaint/incident from the Club Delegate.

Step 4             The person cited to appear must provide the P&D Committee with all statements and information by 7pm two days before the P&D hearing.

Step 5             All persons nominated in the Notice to Attend a P&D hearing must be available to attend.

Step 6             P&D hearing is conducted and a Notice of Determination is forwarded to the club delegate as soon as the notice is completed.

Step 7             Determination is accepted by the person OR appeals process commences as per Appeals Flow Chart outlined on page 5.

                       

FLOW CHART: Appeals Process

Step 1             If a person who has appeared before a P&D hearing disagrees with the determination made by the P&D Committee, they can appeal the decision.

                        The appeal can relate to either; -

(A)  The finding of guilt and/or  

(B)  The severity of the penalty

Step 2             Any appeal in relation to penalties issued where a person has appeared at a P&D Committee hearing must be in the hands of the Secretary within 48 hours of the P&D Committee hearing to appeal the decision and accompanied by the Appeal fee. The submission must contain whether the appeal is in relation to guilt and/or the severity of the penalty.

Step 3             Any person/s not appearing at the next P&D Committee hearing following their send off or upon receipt of their Notice to Appear lose their right of appeal.

Step 4             The NWSWF Secretary will notify the Club Delegate of the Appeal hearing details.

Step 5             The player or person appealing the decision must (via the Club Delegate)  provide the NWSWF Secretary with the list below by 7pm two days before the Appeal hearing:-

                       

1.      A list of people who will be called as witnesses

2.      Copies of witness statements

3.      A short written submission why you consider the P&D decision to be incorrect

4.      Have all witnesses available to attend the Appeal hearing          

Step 6             NWSWF Appeals Committee has the right to refer any appeals directly to the Sydney Branch for consideration.

Step 7             NWSWF Appeals Committee will notify the Club Delegate of the decision as soon as possible after the conclusion of the hearing.

Note:                      The Appeal Committee is at liberty to dismiss the application for a hearing following review of the paperwork should the paperwork be considered to be frivolous or vexatious.
